Meanwhile, as the case moved closer toward presentation to a grand jury, Alex and Derek’s attorneys began making plans to keep the boys out of the Escambia County Jail in the likely event they would be indicted for the murder of their father. James Stokes, Alex’s attorney, indicated that the boys were interacting with boys their own age at the juvenile detention center.

“These are two kids who punch and poke on each other because they are brothers,” Stokes said. “I realize what they are charged with, but they are still only charged. We’re very concerned about their safety in the adult jail.”

If transferred to the jail, they would have to interact with adults or be kept isolated. Stokes indicated that his immediate concern was to keep them in the juvenile facility, indictment or none. Sharon Potter, Derek’s attorney, agreed.

“They’re babies,” Potter said. “Just look at them.”
